association. registered nurses at 8 hospitals operated by sutter hospitals and two san jose hospitals, hospital corporation of america, will go on strike at 7:00 a.m. they are upset about staffing, sick leave and other issues. the strike at sutter hospitals is planned for two days. the strike at the san jose hospital set for one day. the hospitals have hired replacements on a 5 day contract. officials say because of the contracts the striking nurses will not be allowed to return to work till sunday. >>> in a game that was supposed to feature two of the top ranked defenses in the nfl, the 49ers without alex smith, jumped all over the bears, winning 32-7. back up quarterback was terrific out dueling jason campbell. 243 yards, 2 touchdowns, while the 49ers rolled. coming up, gary will have highlights and more on the question, will he start next week over alex myth -- smith. >>> a 65-year-old woman kidnapped sexually assaulted, left by the road, the suspect only 14 and today we are getting our first look at him. still photos were allowed in court today. he made his first court appearance.

at a school in san jose. nbc bay area's marianne favro has been following the story and joins us live from the st. francis cabrini school with the developments. >> reporter: the pastor here at st. francis cabrini church has resigned. we now mow more about the letter from the diocese of san jose that enabled a registered sex offender to volunteer here near kids. this is the letter signed by human resources employee at the diocese of san jose that authorized mark gurries, a registered sex offender to volunteer at st. francis cabrini and parish. and that's what he did that parents say hundreds of kids attended. they blame the letter that allowed him to volunteer. >> it's a statute that we do not agree with. what you have is a registered sex offender that was on school grounds. however, it is in the penal code, it is in the books that if you have permission from a school official, you can be on grounds. >> reporter: the diocese says a former human resources employee wrote the letter in november 2010, just six months after he was sentenced for molesting a child under 14. but the diocese wouldn'

very quickly. by 9:00 a.m. just a little spotty activity south of san jose. by noon today almost completely clear over the greater bay area from the showers and we're also talking about sunshine at that point from santa rosa down to san mateo. still mostly cloudy until about 2:00 p.m. in san jose but we're going to see a nice, sunny finish to the day and highs will be in the upper 60s and low 70s everywhere across the bay area. traffic and weather go hand in hand. let's check on the morning commute with mike inouye. >> mostly cloudy and we're hearing mostly crowdy over at the toll plaza where we have the wet roads. look at that, the water kicks up some of the leftovers from last night's rain. there is the slow at the toll plaza. the map shows you it is moving smoothly but the yellow spots just below 60. i'm going to overlay some weather data. the green here you may have slicker conditions like the bay bridge toll plaza. this is west 580 into livermore, the earlier accident and two accidents reported have both completely cleared from the roadway. a lot of folks headed toward the d

are going over san jose. some of that lighter rain. there is a lot of holmes system. 50s and 60s. 57, santa rosa, napa and fairfield. it's pretty mild. the system will work its way east and south. we will start to see clearing. the next system looks like its heading north. next good rain looks to be november 9th. 60s to near 70 on the temperatures. then afternoon sun, fog will be back, that inland fog, tulle fog which is thick thick thick but temperatures warming up. we set clocks back an hour sunday morning temperatures will be nice though the days are shorter. >> thank you. on to the coverage of sandy. new jersey's governor said the jersey shore he knew and loved may be a thing of the past. there is to much damage and rebuilding it back to the way it was may set it up for another disaster. many gas stations were forced to close. officials are running out of fuel to keep generators running. >>> this is new video out of new york city showing the thousands of people lined up to use buses. the line wraps around the new barkley center in brooklyn where tonight's scheduled opening basketball

san jose to explain what happened in the shooting of a marine in san jose in palm springs. >> reporter: well, this marine attended piedmont high school here in san jose his sophomore and junior here and then transferred out. are calling this a tragedy. here is picture of him. 22 years old. he was stationed out of 29 palms. police in palm springs say two bicycle officers heard yelling in a parking garage and when they entered, they recognized him and his marine friend from a public intoxication from earlier that night and the men started to yell derogatory comments. one of the officers reached in the car. >> the suspect accelerated directly toward the other officer. >> reporter: the officers both fired their weapons and shot him which resulted in his death. the passenger was uninjured. the marine's family told me on the phone he's a good man who served in afghanistan. they say what police is describing is completely out of character. there's an american flag and patriotic stickers. neighbors say the family was also -- the family was always proud of him. >> you think you ar

are still struggling and we're seeing and feeling the effects every day. police officers in san jose, for instance, are resigning instead of putting up with lower wages and lower benefits. there are now less than 1,000 police officers available for full duty, and only 70% of those are out in the street. it's bad. kiet do says there may be a silver lining. >> reporter: clark has a front- row seat to san jose's rising crime rate, when he caught a burglar red-handed in his bedroom. >> you don't expect somebody in your home that doesn't belong there. >> reporter: he used to be the neighborhood watch vice president. he says there have been about ten break-ins in the area in the past six months. he said with fewer cops on the streets, prowlers are getting bold. >> when things go wrong, we need officers there to support us. >> reporter: san jose police have written a special memo to the city about the police shortage. >> the numbers are not good. >> reporter: over the past decade, sjpd went from a high of 1,420 officers to 1024 today. it now drops down to 978. minus detectives, support staf

. >>> we begin with the story of a female body found at a home in san jose. it's a developing story with police still at the scene after getting a 911 call. ktvu's janine de la vega is at the home in south san jose to explain why police suspect this was a homicide. janine? >> reporter: well, tori, police tell us that the woman's body was found face down and she was lying on the floor. the coroner's on the scene right now. at this point, officer are the waiting to get a warrant to search inside this home. authorities received a 911 hangup call and when officers arrived, they heard dogs barking. they called animal control to help. when police finally entered the home, that's when they found the woman's body. while a weapon has not been found, police have reason to believe that she was killed. detectives have been going door to door to see if anyone heard anything. it's unknown who made the 911 call but officers say it did come from the home where the body was found. >> we attempted to call back to confirm there was a prob or determine if there was a problem occur -- problem or determi

this morning around the bay area but it's shifted a bit further to the south into san jose staying dry for most of halloween but now they are seeing the rain falling there. you can see those showers dragging on through. nothing really heavy, just some light rain coming through and beginning to fall apart. now, as we head through the day today, this is going to sag further south and move east so heading out of town into san jose, into milpitas, you're seeing more light early on this morning. roads are slick. so be careful. behind this we have some clearing on the back side. in fact, by the afternoon, probably turning to partly cloudy skies and just a slight chance of a few showers. overlooking san francisco now, still looking good. beautiful skies orange lights and temperatures in the 50s and 60s this afternoon maybe low 70s in the warmest spots but we are thinking 80s in the not too distant future. we'll tell you when coming up. right now let's check the roads with elizabeth. >> we can barely see the dublin interchange roads. westbound 580 in the commute direction, you can see some headlights.

weather in san jose and sunnyvale. there is a light rain and prettmost folks are describing t as a light sprinkle. we are seeing some residual side showers on the back end. we could pick us was traced hours north of the golden gate bridge into the 11:00 hour. a lot of the clouds start to live and we will see more in a way of sunshine as we head into the afternoon complete the track conditions. it is shaping up to be a very nice day. temperatures are not too bad 60 out the door in hayward 57 in napa. it is not to chilly up there there is a slight breeze to contend with. we of cold air coming in with that front as we head into the afternoon mild conditions on tap. 67 for concord laid out in richmond, upper 60s in the south bay and 68 for santa rosa. the seven there on ave forecast shows sunshine as we head into the weekend. >> the dow jones industrial average over up at 1%. u.s. builders are increasing their spending at 0.6% in september for home construction of some solid gains. net flicks that shares were up 13%. the shares are now dropping 4% as the rating was downgraded for net flicks.
